1. About These Terms

These Terms & Conditions ("Terms") govern the sale of products by Tropikol Ltd ("Tropikol", "we", "us", "our"), a company registered in England and Wales (Company No. 16565449), registered office at Cedar House, 3 Broad Street, Enderby, Leicester LE19 4AA, to customers purchasing through tropikol.com (the "Site"). By placing an order with us, you agree to be bound by these Terms.

2. Products and Pricing

We make every effort to display our products and their prices accurately on the Site. All prices are shown in GBP (£) and are inclusive of VAT where applicable, unless stated otherwise. We reserve the right to change prices and product availability at any time without prior notice, though changes will not affect orders already confirmed.

3. Orders and Acceptance

When you place an order, you are making an offer to purchase. We will send an order confirmation by email, but this does not constitute acceptance of your order. A contract between you and Tropikol is only formed once we dispatch your order and send a shipping confirmation. We reserve the right to refuse or cancel any order, for example where a product is out of stock, pricing has been listed in error, or we suspect fraudulent activity.

4. Trade and Wholesale Orders

Trade and wholesale customers are subject to separate agreed pricing, minimum order quantities and payment terms as confirmed in writing (including by email) between Tropikol and the trade customer. Where trade terms conflict with these general Terms, the agreed trade terms take precedence for that order.

5. Payment

Payment is taken at the time of order through our secure checkout, except where alternative payment terms have been agreed in writing for trade customers. We accept the payment methods displayed at checkout.

6. Delivery

Delivery timescales and charges are set out in our Shipping Policy. We currently ship within the United Kingdom. Delivery dates provided are estimates only and are not guaranteed; Tropikol is not liable for delays caused by circumstances outside our reasonable control.

7. Returns and Refunds

Our approach to returns, refunds and cancellations is set out in our Return & Refund Policy, which forms part of these Terms.

8. Product Use and Suitability

Product descriptions, specifications and growing guidance provided on the Site are for general informational purposes. While we take care to ensure accuracy, growing outcomes depend on many factors outside our control (environment, care, water quality, climate, etc.) and we cannot guarantee specific results from use of our products.

9. Limitation of Liability

To the fullest extent permitted by law, Tropikol's liability for any claim arising from your order is limited to the value of the products purchased. We do not exclude or limit liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded or limited under English law.

10. Intellectual Property

All content on the Site, including text, images, logos and branding, is owned by or licensed to Tropikol Ltd and may not be reproduced without our prior written consent.

11. Governing Law

These Terms are governed by the laws of England and Wales. Any disputes arising from these Terms or your use of the Site will be subject to the exclusive jurisdiction of the courts of England and Wales.
